Welcome to Avenir Collectibles.
These Terms of Service ("Terms") govern your use of the Avenir Collectibles website (the "Site") and your purchase of products from Avenir Collectibles LLC ("Avenir Collectibles," "we," "us," or "our"). By accessing our Site or placing an order, you agree to these Terms and our applicable store policies (including our Shipping, Return, and Privacy Policies, incorporated by reference).
If you do not agree to these Terms, please do not use the Site or place an order.
1. Products and Product Information
Avenir Collectibles makes reasonable efforts to ensure that product descriptions, photographs, prices, availability, and other information displayed on the Site are accurate. However, we do not warrant that product descriptions, photographs, or other content on the Site are accurate, complete, reliable, current, or error-free.
Because many of our products are collectibles, actual products may differ in minor respects from photographs shown, including centering, print lines, edge wear, or packaging variations typical of the product's age and manufacturing process. Where a listing photo is a stock or representative image rather than a photo of the exact item, this will be noted in the listing. Any known significant condition issues will be disclosed in the listing description where applicable.
All products are sold "as is" and "as described," to the maximum extent permitted by law. Grading, condition assessments, and authenticity representations are made to the best of our knowledge and are not guarantees against subjective grading differences by third-party graders.
2. Pricing and Availability
Prices and availability are subject to change without notice. Prices listed on the Site do not necessarily reflect current market value and should not be relied upon as an appraisal.
We reserve the right, at our sole discretion, to correct pricing errors, product description errors, availability errors, or other errors, and to cancel any order affected by such an error, at any time before or after order confirmation and before shipment. If an order is cancelled for this reason, any payment received will be refunded in full, and this refund is the sole remedy available.
3. Orders and Order Refusal
We reserve the right to refuse, limit, or cancel any order at our sole discretion, including but not limited to circumstances involving:
- suspected fraud or unauthorized use of a payment method;
- suspected reseller, bot, or bulk-purchasing activity inconsistent with normal retail use;
- inventory or listing errors;
- significant pricing errors;
- abuse of promotions, discounts, or return privileges; or
- any other reason we determine, in good faith, warrants cancellation.
If we cancel a paid order, the applicable payment will be refunded. Order confirmation emails do not constitute acceptance of an order or a binding contract of sale — the contract is only formed when the order ships.
We reserve the right to limit quantities purchased per person, household, or order for any product.
4. Payments and Chargebacks
By placing an order, you represent that you are authorized to use the payment method provided. Filing a chargeback or payment dispute for an order that was accurately described, delivered, and not otherwise eligible for refund under our Return Policy is a misuse of the chargeback process. We reserve the right to contest any such chargeback with the available evidence (shipment tracking, communications, photos, etc.) and to refuse future service to any customer who files a chargeback found to be unwarranted following investigation by the payment processor or card issuer.
5. Shipping and Risk of Loss
Estimated delivery times are provided for convenience only and are not guaranteed. We are not responsible for delays caused by carriers, customs, weather, or other events outside our reasonable control.
6. Authenticity
Avenir Collectibles is committed to selling authentic collectible products. Products are sourced through established suppliers, distributors, reputable marketplaces, and/or established collectors, and we do not knowingly sell counterfeit products.
Graded cards may include certification numbers issued by the applicable third-party grading company. Customers may independently verify certification details through the relevant grading company's verification service. We are not responsible for, and make no representations regarding, the grading standards, consistency, or future decisions of any third-party grading company.
7. Collectible Values
Avenir Collectibles does not guarantee that any collectible will increase, decrease, or hold its value over time. Prices reflect market conditions and information available to us at the time of listing and may not reflect current or future market value.
Purchases from Avenir Collectibles are purchases of collectible merchandise for personal enjoyment or collection purposes. They are not financial products, securities, or investment advice, and should not be treated as such.
8. Returns and Refunds
Except as required by applicable law or expressly stated in our Return Policy, all sales are final. We do not accept returns for buyer's remorse, change of mind, or subjective disagreement with a condition assessment that was accurately disclosed at the time of listing.
Returns for items that are materially not as described, defective, or damaged prior to shipment will be handled in accordance with our published Return Policy, which requires notification within the timeframe stated there along with supporting photo evidence.
9. User Conduct
You agree not to use the Site to: violate any law; infringe on our intellectual property or that of others; attempt to interfere with the Site's normal operation (including scraping, automated purchasing, or bot activity); or engage in fraudulent or abusive ordering behavior. We reserve the right to suspend or terminate access to the Site or refuse service for violations of this section.
10. Intellectual Property
All website content, including text, graphics, logos, photographs, designs, and other materials, is owned by or licensed to Avenir Collectibles LLC unless otherwise indicated. Trading card names, images, and related trademarks remain the property of their respective rights holders and are used for identification and descriptive purposes only. Content may not be reproduced, copied, modified, or used without our prior written permission.
11. Limitation of Liability
To the maximum extent permitted by applicable law, Avenir Collectibles LLC and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or collectible value, arising from your use of the Site or products purchased, even if advised of the possibility of such damages.
To the maximum extent permitted by applicable law, our total liability arising from any order will not exceed the amount you paid for the product(s) giving rise to the claim.
Nothing in these Terms limits any right or remedy that cannot legally be excluded or limited under applicable law, including applicable consumer protection law in your jurisdiction.
12. Indemnification
You agree to indemnify and hold harmless Avenir Collectibles LLC from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your misuse of the Site, violation of these Terms, or violation of any law or third-party right.
13. Dispute Resolution
Before initiating any formal dispute, you agree to first contact us at avenircollectibles@gmail.com so we can attempt to resolve the issue informally.
Any dispute arising from these Terms or your purchase that cannot be resolved informally shall be resolved on an individual basis, and, to the extent permitted by applicable law, you waive any right to participate in a class action or class-wide arbitration. This section does not apply where prohibited by applicable law, including certain consumer protection laws that guarantee access to courts or class proceedings.
14. Changes to These Terms
We may update these Terms at any time. The version posted on the Site at the time of your order governs that order. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
15. Severability
If any provision of these Terms is found unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
16. Governing Law
These Terms are governed by the laws of the State of Florida and applicable federal laws of the United States, without regard to conflict-of-law principles — except where a customer's local consumer protection law mandates otherwise, in which case that local law will apply to the extent required.
